中日欧食品接触材料法规与监管要求比对分析

      为明晰不同经济体之间食品接触材料的监管逻辑与合规要点, 本文从法规体系、新物质评估、产品信息传递及通报预警机制4个维度, 对中国、日本及欧盟相关要求展开对比研究。结果表明, 三方均以“保障食品安全”为核心, 构建“通用法规与特定材质”双层框架, 在良好生产规范(good manufacturing practice, GMP)要求与监管通报体系等方面存在共性。差异体现在新物质评估方面, 中国和欧盟流程成熟, 日本待完善; 标签管理方面中、欧有明确标准, 日本尚未统一。本文可为我国食品接触材料企业的跨境合规提供参考, 并为我国法规体系进一步与国际衔接提供理论支持。

英文摘要:

      To clarify the regulatory logic and key compliance requirements for food contact materials across different economies, this paper conducted a comparative analysis of the relevant regulations in China, Japan and the European Union from 4 dimensions: Regulatory frameworks, new substance assessment, product information transmission and notification and alert mechanisms. The results showed that all 3 jurisdictions took “ensuring food safety” as the core objective and had established a dual-layer framework consisting of general regulations and material-specific requirements, with common features in areas such as good manufacturing practice (GMP) requirements and regulatory notification systems. The differences were mainly reflected in new substance assessment, where the processes in China and the European Union are relatively well developed, while Japan’s system remains to be further improved; and in labeling management, where China and the European Union had clear standards, whereas Japan had yet to establish a unified approach. This study can provide reference for cross-border compliance of Chinese food contact material enterprises and offer theoretical support for the further alignment of China’s regulatory system with international standards.
